CONSUMER TERMS OF SALE

PLEASE READ THESE TERMS OF SALE CAREFULLY BEFORE PLACING YOUR ORDER AND RETAIN A COPY OF THESE TERMS AND YOUR ORDER FOR FUTURE REFERENCE.

1 Formation of the contract

1.1 These terms of sale apply to all goods supplied by Finwood Designs Limited, registered in England and Wales no. 05549116 (“we/us”).

1.2 No contract exists between you and us for the sale of any goods until we have received and accepted your order and send you confirmation in writing or by email to the address or email address you have given. Once we do so, there is a binding legal contract between us. We are under no obligation to accept your order.

1.3 The contract is subject to your right of cancellation (see below).

1.4 We may change these terms of sale without notice to you in relation to future sales.

1.5 If you have any queries about these terms and conditions please contact us by email or telephone before you place your order.

2 Description and Price of the Goods - Placing your Order

2.1 The description and price of the goods you order will be as shown in our current price list or on our website at the time you place your order.

2.2 The goods are subject to availability. If on receipt of your order the goods you have ordered are not available in stock, we will inform you as soon as possible, and refund or recredit you for any sum that has been paid by you or debited from your credit card for the goods.

2.3 Every effort is made to ensure that prices shown in our current price list or shown on our website are accurate at the time you place your order. If an error is found, we will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your order. If you cancel, we will refund or recredit you for any sum that has been paid by you or debited from your credit card for the goods.

2.4 In addition to the price, you may be required to pay a delivery charge for the goods. Further details may be found on our website and we will discuss your delivery requirements with you when you place your order.

2.5 The price of the goods and any delivery charges are inclusive of VAT.

2.6 You may place an order in person, or by telephone, or on our website.

2.7 You place an order on the website by selecting an item and following the instructions.

2.7.1 You will have an opportunity to check and correct any input error in your order up until you click the Submit Order button.

2.7.2 After you have submitted your order you will receive an order acknowledgment email from us. Please note that this email is an acknowledgment and not acceptance of your order.

2.7.3 If you are paying by credit card, we will authorise your debit or credit card payment. If you are paying by cheque, we will deposit your cheque on the first working day after we receive it.

2.7.4 It is recommended that you retain all emails relating to your order and contract.

2.7.5 The details of your specific contract are filed by us. Should you want any information regarding your order you may contact us. (For details see the Contact Us page of the Website or paragraph 9 of these terms and conditions).

3 Payment

3.1 Payment for the goods and delivery charges can be made by any method shown in our current catalogue/price list or shown on our website at the time you place your order.

4 Delivery

4.1 The goods you order will be delivered to the address you give when you place your order, except that deliveries are not made outside mainland United Kingdom. The price of the goods includes Standard Delivery. Standard Delivery for goods weighing less than 50kg, means delivery usually by courier. Standard Delivery for goods weighing 50kg or more means delivery up to a maximum radius of 150 miles from Birmingham City Centre. In each case Standard Delivery includes delivery of up to 15 metres from the delivery drop off point provided that there are no difficulties with access and/or the terrain over which delivery is to be made. Such difficulties may include (without limitation) soft terrain, gravel, or uneven surfaces. We reserve the right to make a supplementary delivery charge where Standard Delivery does not apply. Further details may be found on our website and we will discuss your delivery requirements with you when you place your order.

4.2 If delivery cannot be made to your address, we will inform you as soon as possible, and refund or recredit you for any sum that has been paid by you or debited from your credit card for delivery.

4.3 If there is no one at the address given who is competent to accept delivery of the goods, you will be notified of an alternative delivery date or a place to collect the goods. If we have made prior arrangements with you for delivery of the goods and there is no-one at the address given who is competent to accept delivery of the goods then we may make a supplemental delivery charge.

4.4 Every effort will be made to deliver the goods as soon as possible after your order has been accepted, and in any event within 14 days of your order. However, we will not be liable for any loss or damage suffered by you through any reasonable or unavoidable delay in delivery. In this case, we will inform you as soon as possible.

4.5 You will become the owner of the goods you ordered and responsible for risk of loss of or damage to them once they have been delivered to you or to the address you give when you place your order.

5 Your right of cancellation

5.1 You have the right to cancel the contract at any time up to the end of seven working days after you receive the goods (see below). A working day is any day other than weekends and bank or other public holidays.

5.2 To exercise your right of cancellation, you must give written notice to us by hand, post, or email, at the address, fax number or email address shown below, giving details of the goods ordered and (where appropriate) their delivery.

5.3 If you exercise your right of cancellation after the goods have been delivered to you, you will be responsible for returning the goods to us at your own cost. The goods must be returned to the address shown below. You must take reasonable care to ensure the goods are not damaged in the meantime or in transit.

5.4 Once you have notified us that you are cancelling the contract, we will refund or recredit you within 30 days for any sum that has been paid by you or debited from your credit card for the goods.

5.5 If you do not return the goods as required, we may charge you a sum not exceeding the direct costs of recovering the goods.

5.6 You do not have the right to cancel the contract if the order is for goods which by their nature cannot be returned. We will notify you at the time your order is accepted if this applies.

6 Warranties etc

6.1 Goods will contain stone/natural materials. Stone/natural materials are subject to variations in colour/colours, patterns, markings and texture, and may be subject to flaws. Samples can only be treated as a fair resemblance. We cannot guarantee exact representation nor guarantee against natural flaws.

6.2 Descriptions of materials offered are for guidance only and do not imply suitability for any particular purpose.

6.3 Furniture/other items made of stone may be heavy and difficult to move. It is your responsibility to make sure that the items you order will fit through any gates, passages, stairwells, landings or doorways or other ingress. It is also your responsibility to make sure that all floors, patios and surfaces are strong enough to bear the weight of the goods.

6.4 All goods supplied by us are warranted free from defects for 12 months from the date of supply. This warranty does not affect your statutory rights as a consumer.

6.5 This warranty does not apply to any of the natural goods referred to in clause 6.1 nor to any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than as recommended by us, failure to follow our instructions, or any alteration or repair carried out without our approval.

6.6 If the goods supplied to you develop a defect while under warranty, or you have any other complaint about the goods, you should notify us in writing at the address or email address shown below.

7 Data protection

7.1 We will take all reasonable precautions to keep the details of your order and payment secure, but unless we are negligent, we will not be liable for unauthorised access to information supplied by you.

7.2 We will only use the information you provide about yourself for the purpose of fulfilling your order, unless you agree otherwise. We would like to notify you of products and offers that may be of interest to you from time to time, and if you would like to be notified of these, please tick the box below. You can correct any information about you, or ask for information about you to be deleted, by giving written notice to us at the address or email address shown below.

8 Applicable law

These terms of sale and the supply of the goods will be subject to English law, and the English courts will have exclusive jurisdiction in respect of any dispute arising from the contract.
